GENERAL TERMS AND CONDITIONS OF USE OF THE SITE

Article 1 - Purpose of the Site
The purpose of the site location.pathe.fr (hereinafter the «Site») is to present the offers for the rental of theatrical spaces proposed by Pathé Cinémas, in particular for professional or private events, and to enable users to contact the Pathé Cinémas teams for any request for information, quotation or reservation?
Article 2 - Scope of application and modification of the General Terms and Conditions of Use of the Website
Scope of application :
The General Terms and Conditions of Use of the Site (hereinafter referred to as the «GTCU») govern access to and use of the Site and all associated content and services.
The user (hereinafter the «Visitor») is invited to consult the GCU on a regular basis. The applicable version is the one in force at the time of browsing the Site.
Acceptance :
By accessing the Site, the user acknowledges full and unreserved acceptance of the GCU.
Modification :
Pathé Cinémas reserves the right to modify the GCU at any time in order to incorporate legislative, technical or functional changes. Any modification will take effect as soon as it is published online.
Article 3 - Access to the Site
Access to the Site is free of charge (excluding connection costs).
Pathé Cinémas may, without notice or compensation :
Suspend or limit access to the Site for maintenance or updating; ;
Modify all or part of its content ;
Delete certain functions.
Pathé Cinémas is not liable in the event of temporary or prolonged unavailability of the Site.
Article 4 - Intellectual property
Site content :
The Site and all of its components (text, visuals, photos, logos, videos, graphics, architecture, etc.) are protected by the French Intellectual Property Code and remain the exclusive property of Pathé Cinémas and/or Pathé Marques or their partners.
Any reproduction, representation, adaptation or distribution, in whole or in part, of the content is prohibited without the prior written consent of Pathé Marques and/or Pathé Cinémas.
The trademarks, logos and distinctive signs appearing on the Site are protected. Their unauthorised use is prohibited.
Hypertext links :
The links on the Site may lead to third party sites over which Pathé Cinémas exercises no control and declines all responsibility.
The creation of a link to the Site for commercial or promotional purposes requires prior authorisation from Pathé Cinémas.
Pathé Cinémas may request the removal of a link to the Site at any time.
Article 5 - Visitor behaviour
Visitors undertake to use the Site fairly, responsibly and in accordance with the law.
It is forbidden in particular to:
Publish or transmit any content that is unlawful, defamatory, abusive, discriminatory, obscene or invasive of privacy; ;
Distribute unsolicited advertising (spam); ;
Introduce viruses, malware or any other malicious code into the Site; ;
Disrupt or attempt to disrupt the normal operation of the Site; ;
Access or attempt to access protected areas, data or servers not accessible to the public; ;
Impersonating a person or service; ;
Commit any unlawful act.
In the event of non-compliance, Pathé may take one or more of the following measures, without prior notice:
Restriction or suspension of access to the Site ;
Reporting to the competent authorities ;
Legal action to compensate for the loss suffered.
Article 6 - Liability
Pathé Cinémas will do its utmost to ensure the correct and secure operation of the Site at all times. Under no circumstances can Pathé Cinémas be held responsible for any direct or indirect damage that any Visitor may suffer as a result of consulting or using the Site, whatever the causes, origins, nature or consequences, and in particular in the event of interruption or inaccessibility of the Site as well as in the event of damage resulting from the presence of any malicious computer code, including but not limited to computer viruses, or fraudulent acts by third parties (such as an intrusion) from the Site. The unavailability of the Site does not give rise to any right to compensation. Furthermore, Pathé Cinémas cannot be held responsible in the event of use contrary to the GCU.
Article 7 - Personal data
During browsing or when requesting a quote, Pathé Cinémas may collect personal data (name, contact details, information relating to the request). Pathé Cinémas undertakes to comply with the regulations applicable to the protection of the Visitor's personal data, in particular the European General Data Protection Regulation 2016/679 of 27 April 2016 (hereinafter the «GDPR») and the French Data Protection Act (Loi Informatique et Libertés). The Visitor has a right of access, rectification, portability, deletion as well as a right to limit the processing of his/her data. The Data Protection Officer may be contacted for any request at the following address dataprivacy@pathe.com.
If the Visitor believes that Pathé Cinémas has not processed his or her data in accordance with the regulations on the protection of personal data, the Visitor may lodge a complaint with the CNIL : https://www.cnil.fr/fr/plaintes.

Article 8 - Non-waiver
The fact that Pathé Cinémas does not avail itself of a breach by a user of one of the obligations referred to in these GTC shall not be interpreted for the future as a waiver of the obligation in question.
Article 9 - Applicable law and jurisdiction
The GCU shall be governed by and construed in accordance with French law. Any action arising or resulting from your use of the Site or the GTCU must be brought before the competent French courts.
